Essential Room Solutions reserves the right, at any time, to modify, alter or update these terms of use, and you agree to be bound by such modifications, alterations or updates on subsequent visits.
Any e-mail or other acknowledgement of your order is merely to report that your request has been received and will be looked at, and does not in any way denote acceptance of your order regardless of any wording on the e-mail. An order will be accepted and processed once your credit/charge/debit card has been processed. Confirmation of your order will be sent to the e-mail address given on your order form and whether or not you receive this e-mail our confirmation will create a legally binding contract between us. Essential Room Solutions reserves the right, at any time prior to acceptance, to refuse any order or any part of any order, or to require further or better information to enable it to evaluate and/or process the order.
Purchasing online through this site is 100% guaranteed safe as all card payments are processed by Paypal on behalf of Essential Room Solutions. All prices shown on this website are inclusive of charges for using this process so the prices quoted are the same for all payment methods. In the event that there is a pricing error on the website then Essential Room Solutions will not be bound to honour any orders made at the incorrect price.
The seller shall have no liability in the event of the goods infringing or being alleged to infringe the rights of any third party. In the event that the goods are or maybe the subject of third party rights, the seller shall be obliged to transfer any such title he has but without prejudice to the rights of a consumer for a remedy in the event of total or partial non-performance.
Order Cancellation To cancel on order prior to delivery you must first contact us with your request to obtain a cancellation authorisation number which you must keep a record of. Orders are only cancelled once this number is provided and any claims that an order was cancelled will not be entertained unless a cancellation number can be quoted. An order cannot be cancelled once the order has been given to the warehouse for picking and packing.
In accordance with the Distance Selling Regulations 2000 consumers have the right to cancel their order within a 7day 'Cooling off Period' following the day of delivery. Cancellation must be done by emailing your request and requesting a cancellation authorisation number. If returning goods under this regulation it will be your responsibility to ensure that the goods are received by us in good condition. Essential Room Solutions suggests that insurance is taken out for the return of such goods as any goods not received in a saleable condition in their original undamaged packaging will not receive a refund. Please note that delivery of goods is deemed to be a separate contract of services and is not covered by the cooling off period therefore any refund for goods returned under this regulation will be less our costs for delivering the order to you.
Delivery of Goods Delivery may be affected in one of several ways. Changes to the delivery address made by the purchaser after the goods have been handed to the delivery company may incur an additional charge of £40. Delivery dates are approximate and no liability whatsoever is accepted in respect of late deliveries. If for any reason, the expected delivery will exceed 30days from the date of receipt of order the customer will be informed and given the opportunity to cancel the order. In certain circumstances where large bulky items are being ordered for delivery to very remote locations, there may be an additional carriage charge. If your order falls into this category then you will be notified of the extra cost and given the option of accepting the extra charge or cancelling the order. Do not arrange for a plumber to install the items until after the goods have been received and checked for damage.
Without prejudice to the statutory rights afforded to consumers under Northern Ireland Law, Essential Room Solutions accepts no liability for any failure to ship products where this results from its inability to do so resulting from acts of god, civil commotion, riots, flood, drought, fire, legislation or other factors outside it's control, or it's decision on reasonable grounds not to do so for reasons of suspicion of credit card fraud or similar, provided that it takes all reasonable steps to notify you within 14 days of order placement that products will not be shipped as ordered. In these circumstances Essential Room Solutions will either not process any payment or will immediately refund any payment made, in full. It is the customer's responsibility to ensure that any order is made with sufficient delivery time from the Essential Room Solutions to prevent any disappointment resulting from such non-shipment.
Checking Goods on Delivery All packaging must be inspected for damage on receipt of goods. Any visible damage should be noted on the Carrier's delivery note. For small items that arrive by Carrier you agree to open all boxes and thoroughly check the goods for damage on the day of delivery and notify us of any damage within 48 hours of receipt of goods. If we are not notified within this period we are unable to claim from either the manufacturer or the carrier. You agree to indemnify us in full for any losses we suffer as a result of your failure to notify us within 48 hours.
For bulky deliveries that arrive on pallets you agree to check the goods for visible transit damage before signing the driver's delivery note. If you sign for the goods, even if you write the words 'Unchecked' or similar on the delivery note, then you are accepting that the goods arrived without obvious external damage to the packaging and later claims for carrier damage will not be considered.
If someone else is signing for the goods on your behalf you agree to advise them that the goods must be checked and you accept full responsibility for any loss or damage if they sign on your behalf and fail to check. You agree to indemnify us in full for any losses we suffer as a result of accepting goods and signing a delivery note without checking the goods for carrier damage.
Returns Policy If goods are faulty or damaged upon delivery we must be notified within 48 hours and a returns note and number requested. We will arrange for replacements to be sent free of charge and the faulty/damaged goods collected. All faulty goods returned for credit will be tested and if the item proves not be faulty then the actual cost of delivery to you and the collection costs and a re-stocking charge of 20% will be deducted from the original price paid. Any item returned to us without a completed returns note and a returns number will not be processed or credited.
If you change your mind about the product when you receive it and you return the goods within the 7 days in accordance with the Distance Selling Regulations 2000 then no re-stocking charge will be applied. However it is your responsibility to make arrangements for the items return and to ensure that the product is returned to us in a saleable condition in its original packaging and not marked in any way. We suggest that carrier insurance is taken out because if the goods do not arrive in re-saleable condition then a refund will not be made. As the contract for delivery is a separate issue not covered by the Distance Selling Regulations then the full costs of the delivery to you will be deducted from the refund. This charge will be the actual delivery cost and in most cases will be higher then the delivery cost charged on the order. In the case of heavy items such as complete shower enclosures the actual cost could be as much as £100.

Essential Room Solutions accepts liability for damage to property where and to the extent that it arises from the negligence of Essential Room Solutions or its servants and agents, up to a limit, in relation to any one event or series of events arising from a common cause, of one thousand pounds (£1,000).
Except as provided above there are no other warranties, conditions or other terms, express or implied, statutory or otherwise, and all such terms are hereby excluded to the maximum extent permitted by law. Essential Room Solutions accepts liability for any indirect or consequential loss if it arises from the negligence of Essential Room Solutions or of its servants and agents, up to a limit, in relation to any one event or series of events arising from a common cause, of ten thousand pounds (£10,000). Essential Room Solutions does not accept any liability for any other form of indirect or consequential loss.
